1. Agreement to these terms
These Terms of Service (“Terms”) govern access to and use of the Jomioz website (including jomioz.com and its subpages), the Jomioz web and mobile software, Client Hub, and related services (together, the “Service”).

By creating an account, inviting users, clicking to accept these Terms, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that organization, and “you” includes that organization.

2. Key definitions
“Account Owner” means the business customer that registers for a Jomioz workspace and is responsible for the subscription, billing, and configuration of that workspace.
“Employee Users” (or team users) means individuals the Account Owner authorizes to access the Service under the Account Owner’s workspace (for example office staff or field technicians).
“End Users” means the Account Owner’s own customers and contacts whose personal data or job-related content is stored or processed in the Service.
“Customer Data” means business data, files, and content that you or your End Users provide to the Service, including customer contacts, properties, jobs, schedules, estimates, invoices, notes, photos, attachments, signatures, messages, and similar operational content.
3. The Service (what Jomioz is)
Jomioz is cloud software for field-service and home-service businesses. Depending on your plan and configuration, the Service may include customer and property management; scheduling and job dispatch; estimates and invoices; price books and intake/request forms; customer payment collection via Jomioz Payments (powered by Stripe); a branded Client Hub for approvals, deposits, e-sign, and rescheduling; email and (where connected) SMS/WhatsApp messaging; checklists and time tracking; roles and permissions; and assistive AI drafting features on eligible plans.
Availability of currencies, payment methods, and messaging channels depends on configuration, plan, and local provider support.
We may add, change, or discontinue features, integrations, or plans to improve the Service, comply with law, or manage security and cost. We will use reasonable efforts to keep the Service available, but the Service is not fault-free and is not a substitute for your own business, legal, tax, safety, or professional judgment.
In particular, you are responsible for confirming that invoices and tax settings you use in the Service meet the rules that apply to your business and your End Users. See Section 8.
Unless we separately agree otherwise in writing, Jomioz does not provide a service level agreement, guaranteed uptime, or guaranteed response time under these Terms. Export and keep copies of records that are critical to your business or legal retention duties.
4. Accounts, Account Owner, and team users
You must be of legal age in your place of residence to use the Service. You must provide accurate registration and billing information and keep it current. You are responsible for all activity under your workspace and for maintaining the security of credentials. Optional two-factor authentication is available and recommended. Notify us promptly at info@jomioz.com or via in-app support of any suspected unauthorized use.
The Account Owner controls who may access the workspace, what roles they have, and how Customer Data is used. Employee Users must use the Service only as authorized by the Account Owner. The Account Owner is responsible for its Employee Users’ compliance with these Terms.
You may not share login credentials in a way that bypasses seat or role limits on your plan. We may suspend accounts that we reasonably believe are compromised, abusive, or used in violation of these Terms.
5. Plans, fees, trials, and taxes
Paid use of the Service is subject to the plan, seat counts, price, currency, and billing period you select (or that apply after a trial). Unless we say otherwise or law requires, fees are billed in advance and are non-refundable. You authorize us and our payment processor (Stripe) to charge your payment method for recurring fees and applicable taxes.
You are responsible for taxes associated with your purchase of Jomioz, except taxes based on our income. Taxes you charge your End Users, and your own VAT/sales-tax compliance, remain your responsibility. We may change prices with notice before the next renewal; if you do not agree, cancel before renewal. Failure to pay may result in suspension or termination of access.
If you are on a free trial, its length and what happens when it ends are as shown in the product or order flow at signup.
6. Customer Data and our role
You retain ownership of Customer Data. You grant Jomioz a worldwide, non-exclusive license to host, process, transmit, back up, display, and otherwise use Customer Data solely as needed to provide and secure the Service on your documented instructions, and to create aggregated or anonymized statistics that do not identify you or any natural person. We do not use Customer Data to train third-party foundation models.
For Customer Data your organization controls about End Users, your organization is typically the controller and Jomioz acts as a processor (or US “service provider”) on your documented instructions, as described in our Privacy Policy and any Data Processing Agreement (DPA) we enter into with you. You warrant that you have a lawful basis to submit Customer Data and that it does not violate third-party rights.

7. Customer messaging and marketing compliance
If you use the Service to email, text, WhatsApp, or otherwise contact End Users, you are solely responsible for complying with applicable laws in every country where you or your recipients are located — including consent, opt-out, and content rules (for example ePrivacy and anti-spam rules in Europe, and TCPA, CAN-SPAM, and similar US rules).
You must not use Jomioz to send unlawful spam, phishing, or deceptive communications. We may suspend messaging features if we reasonably believe they are being abused or create legal or carrier risk.
8. Payments, invoices, and tax compliance (your responsibility)
Customer payment collection (deposits, invoices, and related pay links) is provided through Jomioz Payments, which is powered by Stripe and related Stripe products. Your use of those payment services is also subject to Stripe’s terms and connected-account requirements. Jomioz is not a bank or payment institution; settlement timing, chargebacks, and payout eligibility are governed by Stripe and applicable payment-network rules. Payment card data is processed by Stripe; we do not store full card numbers on our servers for reuse outside Stripe’s tools.
Invoices, tax, and local compliance are yours alone. Jomioz is software that helps you create, send, and track estimates and invoices from job data you enter. We do not provide tax, accounting, bookkeeping, or legal advice. We do not warrant that any estimate, invoice, credit note, tax rate, tax label, numbering, e-invoicing format, reporting file, or fiscal output generated or suggested by the Service is correct, complete, or compliant with the laws of any country, state, or locality where you or your End Users are located.
You are solely responsible for:
- choosing correct tax rates, exemptions, currencies, and invoice content;
- complying with invoicing, e-invoicing, VAT/GST/sales-tax, retention, and reporting rules that apply to your business;
- verifying that documents you send to End Users meet requirements in their and your jurisdictions;
- filings, audits, penalties, and disputes with tax authorities or End Users arising from documents or amounts you create or approve in the Service.
If the Service shows default tax settings, templates, calculators, or helpers, those are convenience tools only and may be incomplete, outdated, or wrong for your situation. You must check them before you send or rely on any document. If you are unsure, consult your own accountant or lawyer.
To the maximum extent allowed by law, Jomioz is not liable for any claim, loss, penalty, interest, or cost arising from non-compliant, incorrect, or incomplete invoices or tax treatment — including claims by your End Users, tax authorities, or third parties — except where such liability cannot be limited under applicable law.
9. Acceptable use
You may use the Service only for lawful business purposes. You will not: (a) use the Service in violation of law or rights of others; (b) upload malware or attempt to breach our or others’ security; (c) use the Service to send unlawful spam or deceptive communications; (d) access non-public areas or other customers’ data; (e) resell, scrape, or reverse engineer the Service except where applicable law does not allow this restriction; (f) interfere with availability of the Service; (g) use the Service to process data you are not authorized to process; or (h) use the Service in a way that we reasonably believe harms us, other customers, or the public.
The Service is not designed for HIPAA-regulated healthcare data, PCI cardholder data storage outside Stripe, or other specialized regulated data unless we expressly agree in writing. Do not submit such data to the Service.
We may suspend or terminate access for material breach, unlawful use, non-payment, or risk to the Service or other users, with notice where reasonably practicable.
10. Assistive and AI features
On eligible plans, the Service may offer drafting, summarization, pricing-form assistance, or similar AI features powered by third-party model providers. Outputs may be wrong or incomplete. You remain solely responsible for reviewing, editing, and using any content before you rely on it with customers, regulators, or in contracts.
Do not submit sensitive personal data to AI features unless necessary and lawful. We do not use Customer Data or AI prompts to train third-party foundation models. Processing of prompts and outputs is described in our Privacy Policy.
11. Beta, preview, and early access features
From time to time we may label features as beta, preview, pilot, early access, waitlist, or similar. These features may be incomplete, unstable, changed materially, or discontinued at any time, and may be subject to additional usage limits or notices.
Beta or early access features are provided for evaluation and product improvement and may have reduced support, security hardening, documentation, or compatibility compared with generally available features.
12. Third-party services and integrations
The Service may connect to or embed third-party services that you enable or that are required to run core features — for example Stripe (Jomioz Payments and subscription billing), Resend (email), Twilio/Meta (SMS/WhatsApp where connected), Mapbox (maps/routing), OpenAI (AI assist), Google sign-in, PostHog (product analytics), and hosting/storage providers. Those services are between you and the third party under their terms and privacy policies, except to the extent mandatory law requires otherwise.
Payment card data for customer charges and subscription billing is processed by Stripe. We do not store full card numbers on our servers for reuse outside Stripe’s tools.
13. Support
We may provide onboarding, help, and support through documentation, email, in-app messaging, or other channels we make available from time to time. Unless we expressly agree otherwise in writing, support is provided on a commercially reasonable basis only, and we do not guarantee particular support hours, response times, or resolution times under these Terms.
14. Intellectual property and feedback
Jomioz and its licensors own the Service, the software, the brand, and our documentation. Except for the limited right to use the Service under these Terms, you receive no ownership rights. You may not remove our notices, copy our look and feel in a way that causes confusion, or use our name or logo except as we expressly allow in writing.
If you provide feedback, ideas, or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
15. Confidentiality
Each party may receive confidential information from the other. The receiving party will use it only for purposes of the relationship and protect it with reasonable care, except for information that is public, independently developed, or rightfully received from a third party without duty of confidentiality.
16. Disclaimers and limitation of liability
To the maximum extent allowed by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We do not warrant uninterrupted service, error-free output, or fitness for a particular purpose.
To the maximum extent allowed by law, Jomioz and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from these Terms or the Service. Our aggregate liability for any claim in any twelve-month period is limited to the greater of the fees you paid to Jomioz for the Service in that period, or one hundred (100) euros (or the equivalent in the currency of your subscription), except where the law does not allow such a cap.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be limited under applicable law. Mandatory consumer protections in the EU/EEA, UK, or elsewhere remain unaffected.
17. Indemnity
You will defend and indemnify Jomioz and its officers and employees against third-party claims, damages, and costs (including reasonable legal fees) arising from your use of the Service, your Customer Data, your End Users, your messaging or marketing practices, your invoicing or tax/fiscal compliance in any jurisdiction (including claims that documents created or sent with the Service were incorrect or non-compliant), or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
18. Term, suspension, cancellation, and termination
These Terms apply while you use the Service. You may stop using the Service at any time. If you are on a paid plan, cancellation will generally take effect at the end of the current paid billing period unless we say otherwise in the product, your order form, or applicable law.
We may suspend or end access for operational, legal, billing, abuse-prevention, or security reasons, or for repeated or material breach. Where reasonably practicable, we will try to provide notice before suspension or termination, but we may act immediately where needed to protect the Service, other customers, or comply with law.
Before the end of an active subscription, and for a reasonable period after termination or non-renewal where technically and operationally feasible, you should export any Customer Data you need. We do not promise indefinite post-termination hosting unless we separately agree otherwise in writing. Provisions that by nature should survive (for example ownership, limitations of liability, indemnity, and payment obligations accrued before termination) will survive termination.
19. Governing law and disputes
These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Subject to mandatory consumer protections where they apply, the courts of Spain have exclusive jurisdiction over disputes arising from these Terms or the Service.
If you are a consumer in the EU/EEA or UK with mandatory local rights, those rights remain unaffected. Nothing in this section limits rights that cannot be waived under the law of your place of residence. If a separate written order form identifies a different contracting entity or venue, that writing controls for that order.
20. Changes; security; contact
We may update these Terms by posting a new version on the website and updating the “Last updated” date. If a change is material, we will take reasonable steps to inform you (for example by email or in-app notice) before it applies to you. Your continued use after the effective date of changes constitutes acceptance of the changed Terms, unless your law requires a different process.
